Terms and Conditions for KOPYTO Sets and Gift Sets

("Set Terms and Conditions")

§ 1. General Provisions
  1. These Set Terms and Conditions set out the rules for the sale, use and return of products offered in the online store www.kopyto.com as "SET", "GIFT SET" or "CHRISTMAS SET" ("Set" or "Sets").
  2. Sets are offered by Z Kopytem spółka z ograniczoną odpowiedzialnością with its registered office in Sopot, ul. Władysława Łokietka 46/1, 81-736 Sopot, Poland, KRS: 0000617134, NIP: 5851474404, REGON: 364408532, BDO: 000635824, email address: [email protected] (hereinafter: "Seller").
  3. These Set Terms and Conditions form an integral part of the Terms and Conditions of the kopyto.com online store, available at: https://kopyto.com/page/terms-and-conditions (hereinafter: "Store Terms and Conditions"). In matters not regulated by these Set Terms and Conditions, the provisions of the Store Terms and Conditions and generally applicable law shall apply.
  4. These Set Terms and Conditions apply exclusively to products expressly marked in the Store as SET or GIFT SET.
  5. These Set Terms and Conditions do not apply to orders in which the Customer independently selects products and uses discount codes, such as "cheaper in a bundle", "quantity discounts" or other promotions — such purchases are governed by the Store Terms and Conditions and are treated as the purchase of individual products, not as a Set within the meaning of these Terms and Conditions.
§ 2. Definitions

For the purposes of these Set Terms and Conditions, capitalised terms have the meanings assigned to them below, unless the content of the provisions clearly indicates a different understanding:

Set – a single product offered in the Store under one trade name and one price, consisting of at least two items combined within a single sales offer (e.g. hat + snood scarf, hat + gloves, gift set). The composition of the Set is indicated on the Product Page.

Product Page – a separate subpage of the Store containing information about a given Set, in particular its composition, description, price and availability.

Customer – a natural person, legal person or organisational unit making a purchase of a Set in the Store, as defined in the Store Terms and Conditions.

Consumer – a natural person performing a legal transaction not directly related to their business or professional activity; an Entrepreneur with Consumer Rights, as defined in the Store Terms and Conditions, shall also be regarded as a Consumer.

Sales Agreement – a distance agreement for the sale of a Set concluded between the Seller and the Customer, on the terms set out in the Store Terms and Conditions.

§ 3. Nature of Sets
  1. A Set constitutes a single product within the meaning of the Sales Agreement — it is offered under one trade name and one total price, covering all items indicated on the Product Page.
  2. The price of a Set is lower than the sum of the regular prices of the individual items purchased separately, which results from the nature of the Seller's promotional offer.
  3. Unless the Product Page specifies otherwise, a Set is not delivered in dedicated gift packaging.
  4. Gift Sets may — exclusively in cases expressly indicated on the Product Page — be enhanced with decorative elements or gift packaging.
§ 4. Withdrawal from the Sales Agreement (Return)
  1. A Customer who is a Consumer has the right to withdraw from the distance Sales Agreement for a Set without giving any reason, within 14 days of taking the Set into possession. To comply with the deadline, it is sufficient to send the declaration of withdrawal before its expiry.
  2. The declaration of withdrawal may be submitted:
    1. in writing to the Seller's address: Z Kopytem sp. z o.o., ul. B. Spiechowicza 36, 43-300 Bielsko-Biała, Poland, or
    2. by email to: [email protected].
  3. The Customer may use the withdrawal form available on the Store's website at: https://kopyto.com/returns-and-complaints, but this is not mandatory.
  4. Since a Set constitutes a single product (§ 3 sec. 1 of these Terms and Conditions), withdrawal from the Sales Agreement covers the Set as a whole. This means that the Customer returns all items forming part of the Set together.
  5. The Customer is obliged to return the Set no later than 14 days from the date of submitting the declaration of withdrawal from the Sales Agreement.
  6. The Customer shall bear the direct costs of returning the Set, unless the Seller has expressly agreed to cover them.
  7. The Seller shall refund to the Customer all payments made, including delivery costs (with the exception of additional costs arising from the Customer's choice of a more expensive delivery method than the cheapest available delivery method), no later than within 14 days of receipt of the declaration of withdrawal. The Seller may withhold the refund until receipt of the Set or proof of its dispatch.
  8. The refund shall be made using the same payment method as that used by the Customer, unless the Customer expressly agrees to a different method of refund.
  9. The Customer is liable for any reduction in the value of the Set resulting from using it in a manner beyond what is necessary to determine its nature, characteristics and functioning. In the event of such a reduction in value being identified, the Seller is entitled to reduce the refund amount accordingly, in accordance with Art. 34 sec. 4 of the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2024, item 1796, as amended; "Consumer Rights Act").
  10. The Seller recommends that the Set be returned in a complete condition — with all items, with tags, in its original packaging (where possible), without signs of use beyond what is necessary to determine the nature and characteristics of the individual items. The foregoing constitutes a recommendation only and is not a condition for the validity of withdrawal from the agreement.
§ 5. Exclusions from the Right of Withdrawal

The statutory right of withdrawal from the Sales Agreement does not apply to the Consumer in the event of:

  1. the expiry of the statutory 14-day period for submitting the declaration of withdrawal — the right of withdrawal expires upon the lapse of that period;
  2. where the subject of the Sales Agreement is a non-prefabricated item produced according to the Customer's specifications or serving to satisfy their individual needs;
  3. where the subject of the Sales Agreement is a product delivered in sealed packaging whose opening prevents return for reasons of health protection or hygiene;
  4. in other cases indicated in Art. 38 of the Consumer Rights Act.
§ 6. Complaints
  1. A Customer who is a Consumer is entitled to submit a complaint concerning a Set.
  2. The Seller is liable for the conformity of the Set with the Sales Agreement; in particular, the Seller is obliged to deliver to the Customer a Set free from defects and in conformity with the Sales Agreement concluded.
  3. The Seller is liable for a lack of conformity of the Set with the Sales Agreement existing at the time of its delivery and disclosed within 2 years of that time.
  4. A complaint may be submitted by the Consumer in any form, in particular:
    1. in writing to the Seller's correspondence address: Z Kopytem sp. z o.o., ul. B. Spiechowicza 36, 43-300 Bielsko-Biała, Poland;
    2. by email to: [email protected].
  5. A complaint is submitted in respect of the Set as a single product. Where a defect concerns only one item of the Set, the Consumer may demand that only that item be brought into conformity with the agreement (repair or replacement), provided this is possible given the nature of the Set. The Seller shall handle each request individually, with due regard for the Consumer's rights under the Consumer Rights Act.
  6. In the event of a lack of conformity of the Set or any of its items with the Sales Agreement, the Consumer may demand:
    1. repair, or
    2. replacement.
  7. The Seller may effect replacement when the Consumer demands repair, or effect repair when the Consumer demands replacement, if bringing the Set into conformity with the agreement in the manner chosen by the Consumer is impossible or would entail excessive costs for the Seller.
  8. The Consumer is also entitled to submit a declaration of a price reduction or withdrawal from the Sales Agreement, in the cases specified in Art. 43e of the Consumer Rights Act, in particular where:
    1. the Seller has refused to bring the Set into conformity with the agreement;
    2. the Seller has failed to bring the Set into conformity with the agreement within a reasonable time;
    3. the non-conformity of the Set with the agreement is so significant as to justify a price reduction or withdrawal from the agreement without prior demand for repair or replacement.
  9. The Seller shall respond to the complaint without undue delay, no later than within 14 days of its receipt. Failure to respond within that period shall constitute acceptance of the complaint by the Seller.
  10. It is recommended that in the content of the complaint the Consumer provides:
    1. information and circumstances relating to the subject matter of the complaint, in particular the type and date of disclosure of the defect;
    2. the requested method of bringing the Set into conformity with the Sales Agreement or a declaration of a price reduction or withdrawal from the Sales Agreement;
    3. contact details (name and surname, correspondence address, telephone number, email address) — this will facilitate and expedite the handling of the complaint by the Seller.

The above requirements are recommendations only and do not affect the validity of complaints submitted without meeting them.

§ 7. Final Provisions
  1. These Set Terms and Conditions are available on the website www.kopyto.com.
  2. The Seller reserves the right to amend these Set Terms and Conditions for legitimate reasons, in particular in the event of changes to applicable law or changes to the Sets offer. Amendments shall not affect Sets purchased prior to the date on which the amendments enter into force.
  3. The Seller shall notify Customers of any amendment to these Set Terms and Conditions by publishing the updated version on the Store's website.
  4. In matters not regulated by these Set Terms and Conditions, the provisions of the Store Terms and Conditions and generally applicable law shall apply, in particular:
    1. the Consumer Rights Act;
    2. the Act of 23 April 1964 – Civil Code (consolidated text: Journal of Laws of 2025, item 1071, as amended);
    3. the Act of 18 July 2002 on the provision of services by electronic means (consolidated text: Journal of Laws of 2024, item 1513, as amended).
  5. These Set Terms and Conditions are in force from 14 May 2026.
